1 Cancellations

1.1 | If the client wishes to cancel their event, any cancellation must be submitted in writing. This is to provide the Agent with an actual statement clarifying the cancellation. Phone calls are not a reliable receipt of a cancellation. Cancellation fees apply and vary depending on the amount of time left until the event. The portion of the balance which would still be payable to the artist for different time frames is as follows:

Time between Cancellation and Event Date Portion of Balance Payable to Artist still due:
Over 90s days 50%
60 – 90 days 75%
Up to 60 days 100%

1.2 | In all instances of cancellation, the booking fee is non-refundable. Booking fees cover administrative costs liaising between ‘Artist’ and ‘Client’ through the booking process. All client, artist emails and telephone conversations. Creating booking contracts, liaising with venues, event managers, promotions and marketing through social media, print and press.

1.3 | If the artist has cancelled for reasons not covered under “Force Majeure”, the client may pursue legal action. In this instance, the Artist must also pay the Agent the equivalent of the clients booking fee within 7 days as an administrative fee.

Additionally, the Artist must also reimburse the Client for cost differences between the fee for their performance (event date) and any substitute ‘Artist’ arranged by the Agent.

2 Force Majeure

2.1 | Events cancelled which fall under ‘exceptional circumstances’ include; acts of nature (flooding, fire, storm, natural disaster). War, terrorist activities, death certified by a medical practitioner, epidemic, order of government or local authority having jurisdiction in the matter or changes in law. Under these circumstances, no party shall be held liable for failure to carry out its obligations. Events can be rescheduled again under these ‘exceptional circumstances’ and a credit note is offered to the value of the original booking fee to be used in for any event and future date. The original artist should be booked for any rescheduled events, and where not possible, due to prior engagements another artist can be booked.

3 Payment

3.1 | For private events the Client shall pay the entire balance remaining directly to the Artist 7 days prior to the event (as indicated on the contract), plus any additional overtime charges, in pounds sterling, no later than the end time on the day of the event. Payment Method should be agreed directly with the Artist.

3.2 | For corporate events and exclusive Artists, payments are made directly to the Agent (Nouveau Music Events) 7 days prior to the event and artists paid up to 14 working days after the event upon receipt on an invoice. If the payment is expected later (21-28 days) from clients – after events booked at short notice, the Agent will notify Artist under these exceptional payment terms.

3.3 | The total fee agreed upon applies to the performance times set forth as indicated in this agreement. On the day of the event, adding additional performance time at the request of the Client is at the discretion of the Artist for a fee negotiated directly between the Client & the Artist. The Artist also holds the right to refuse this request without penalty.

3.4 | The ‘Artist’ must be paid in line with the agreement on the booking contract (usually 7 days prior to the event). If not prearranged, a late payment administration fee will be charged at £50.00 by the Agent to the Client, per week starting on the first day after payment is late to a maximum of 14 days. All small claims fees and attorney fees will be charged onto the Client’s balance and made payable to the Artist, if legal action is the only apparent option for payment of services rendered. For private events where the Client is to pay the Artist directly, the Agent is not responsible for collection of the Artist fee.
